Terms and Conditions
1. Simple Diary is wholly owned, developed and is maintained by Horizon IT (Global) Ltd.
2. Simple Diary is copyrighted to Horizon IT (Global) Ltd.

System Availability
1. Horizon IT endeavour to provide maximum availability of the Simple Diary system.
It is not possible to guarantee 100% system availability.
Systems maintenance, program upgrades and hardware and software issues, may result in Simple Diary downtime.
Wherever possible Horizon IT will give advance warning of system downtime.

2. Horizon IT reserves the right to suspend or cancel a customer's access to any or all services provided when Horizon IT decides that the account has been inappropriately used or otherwise.

3. Horizon IT shall not be liable for any loss or damage of whatsoever nature suffered by You arising out of or in connection with any breach of this Agreement by You or any act, misrepresentation, error or omission made by You or on Your behalf.

4. Horizon IT will not be liable for any indirect loss, consequential loss, loss of profit, revenue, data or goodwill howsoever arising suffered by You or for any wasted management time or failure to make anticipated savings or liability You incur to any third party arising in any way in connection with this Agreement or otherwise whether or not such loss has been discussed by the parties pre-contract or for any account for profit, costs or expenses arising from such damage or loss.

Data Protection and Privacy

GDPR Statement
Horizon IT acts as a Data Processor for its subscribers, basic GDPR compliance remains the responsibility of the subscribers Data Controller.
Horizon IT processes and manages the data subject requested jobs on behalf of the subscriber.
No sensitive personal data stored on database.
Data can be manually anonymised by Horizon IT at the request of the subscriber.

Horizon IT's full Data Protection Policy

General Data Protection
1. The data entered into the system is stored on Horizon IT’s dedicated password protected database.
2. No private or sensitive customer data should be stored on the Job details, including, but not exclusively:
• Social security number
• Date of Birth
• Credit or debit card detail
• PIN or security codes
• Bank account or sort code
• Private information, medical records, sensitive personal information, etc.

3. The Simple Diary database is backed up every evening, should data loss occur Horizon IT will make every attempt to recover the data, but Horizon IT cannot guarantee complete data recovery.

4. Horizon IT will not share the customer details contained within the Simple Diary database.

5. Management of the Simple Diary client data is the sole responsibility of the client. Horizon IT will not examine or monitor the data content, only for maintenance and diagnostic purposes would the client data be accessed.

6. The Simple Diary database is held on servers that reside within the UK and the system is fully compliant with the Data Protection Act.

Invoices and Payments
1. Invoices for usage of the system will be issued on the 1st day of each calendar month.
2. The invoice covers usage for the upcoming calendar month.
3. The standard billing period for the system is one calendar month, beginning on the first day of each month.
4. Payment for usage of the system is due on the 2nd day of each month, payments to be made by standing order.
5. Should customer be unable or unwilling to pay by standing order, a 20% admin fee will be added to the price of the package. The customer will have 14 days, from the invoice date, to complete payment by electric transfer or cheque.
6. Should payment not be received the Simple Diary service will be suspended until outstanding invoices are cleared.
